1. Definitions
In these Terms:
“Scapa 3D,” “we,” “us,” or “our” refers to Scapa 3D Ltd.
“Customer” or “you” means the person or entity purchasing Goods from us.
“Goods” means the 3D printed products or services we supply.
“Custom Goods” refers to items manufactured to the Customer’s specifications.
2. Orders and Acceptance
A contract forms once we confirm your order via email or begin production. We reserve the right to refuse or cancel any order prior to dispatch. For Custom Goods, we will confirm all specifications before production starts.
3. Pricing and Payment
Prices are listed in GBP and include VAT where applicable. Shipping costs are calculated at checkout. Payment must be made in full before production, unless agreed in writing. Payment can be made via Stripe, Tide Bank transfer, or invoice (if approved).
4. Production and Delivery
Lead times vary by item type. Standard orders are usually dispatched within 5 working days. Custom Goods may take longer.
Delivery is carried out by third-party couriers. Risk in the Goods passes to the Customer upon dispatch from our premises. We are not liable for delays or damage caused in transit unless insured delivery has been arranged by us.
5. Inspection and Claims
You must inspect Goods within 48 hours of delivery. If you discover any defects or damage, you must notify us in writing with supporting evidence (e.g. photographs) within that time. Claims made after 48 hours may not be accepted.
6. Returns and Cancellations
Custom Goods are exempt from the statutory 14-day cancellation right under UK Consumer Law unless faulty. Cancellations are only possible if production has not yet begun.
Non-custom items may be returned within 14 days, provided they are unused and in original condition. Return shipping costs are the Customer’s responsibility unless the item is defective.
7. Intended Use & Engineering Disclaimer
Scapa 3D supplies parts based on Customer specifications and makes no representations as to their suitability for structural, submerged, load-bearing, aerospace, marine, medical, or other mission-critical applications.
It is the Customer’s sole responsibility to assess fitness for use, perform necessary validation/testing, and assume all associated risks.
8. Intellectual Property
You retain ownership of any design files submitted. By placing an order, you grant Scapa 3D a non-exclusive license to use, modify, or reproduce these files solely for the purpose of fulfilling your order.
Scapa 3D retains all rights to original designs or modifications created by us unless agreed otherwise in writing.
You warrant that submitted designs do not infringe on any third-party intellectual property rights. You agree to indemnify Scapa 3D against any claims arising from the use of such designs.
9. Limitation of Liability
To the fullest extent permitted by law:
Scapa 3D’s total liability for any claim arising out of or related to your order is limited to the total amount paid for the affected Goods.
We expressly exclude any liability for indirect, incidental, or consequential damages, including loss of profit, equipment damage, business interruption, or reputational harm.
We are not responsible for damage or loss resulting from improper use, misuse, or failure of Goods.
10. Force Majeure
We shall not be liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to supply chain issues, courier disruptions, equipment failures, or natural disasters.
11. Data Protection
We comply with UK GDPR regulations. Your data is processed securely and only used to fulfill your orders or communicate with you. See our Privacy Policy for full details.
12. Governing Law
These Terms are governed by the laws of Scotland. Any disputes arising from the contract shall be subject to the exclusive jurisdiction of the Scottish courts.
